Privacy statement

For proper treatment it is necessary that I, as your practitioner, create a file. This is a legal obligation imposed by the Medical Treatment Agreement Act (WGBO). Your file contains your personal data, notes about your state of health and information about the examinations and treatments carried out. The file also contains information that is (or may be) necessary or important for your treatment, for example your living and working situation, hobbies, family situation/marital status. Or data that, after your explicit permission, has been requested from your general practitioner or another healthcare provider.

I will do my best to protect your privacy in accordance with the General Data Protection Regulation (AVG):

  • by carefully handling your personal and medical data
  • and by ensuring that unauthorized persons do not have access to your data.

Agreements are made about this with colleagues, for example, and measures are taken to keep the data safe.

I am bound by the Privacy Regulations of the Dutch Acupuncture Association (NVA). You can view these regulations on the NVA website www.acupunctuur.nl

Only myself, any trainee present (after your permission) and my deputy in my absence (after your permission) have access to the data in your file. They all have a duty of confidentiality.

A small part of your file (name, address, place of residence, date of birth, e-mail address) is provided to an authorized person for financial administration.

What data is collected and how it is used

I note in your file: name, address, place of residence, telephone number and e-mail address,
date of birth, medical data, relevant social data (e.g. relationship, children, living and working situation, hobbies/sports).

When treating minors under the age of 16, the name, address details, telephone number and e-mail address and written consent of both parents are saved.

The creation of a file is necessary for the implementation of the treatment agreement and is mandatory in the Medical Treatment Agreement Act, WGBO, with a retention period of at least 15 years after the last change or addition. The purpose of the data recording is to be able to perform an acupuncture treatment.

The data in your file can also be used:
• to inform other healthcare providers (with your permission), for example when the treatment has been completed or when referring to another practitioner;
• for use (with your permission) by a replacement during your therapist’s absence;
• for anonymous use during peer consultation, teaching trainees or other teaching purposes;
• for anonymous use (with your permission) in scientific research
If I want to use your data for another reason, your permission will be requested.

A financial administration is a legal obligation for every entrepreneur. The purpose of the data processing is correct billing and tax reporting. The legal retention period of this data is 7 years. A processing agreement has been concluded with the financial administration.

The invoice contains the data required by the legislator and health insurer: your name, address, place of residence, your customer number, the date of the treatment, possibly BSN, short description of the treatment, a performance code, namely 24104 acupuncture, and the costs of the treatment.

Your rights

  • I refer you to my privacy policy, which can be found on my website
  • At the intake I will conclude a treatment agreement with you; for your consent to the recording and processing of your data; this will be included in your file.
  • I do not record more data than is necessary for the described purpose
  • You have the right to withdraw consent granted; this can be done in writing or by email
  • You have the right to inspect, correct, delete and take your own data with you (data portability); this can be done in writing or by email
  • You have the right to submit a complaint about how I handle your personal data to me and to the Dutch Data Protection Authority,  www.autoriteitpersoonsgegevens.nl.

Email contact via the contact form on the website or via your own email program is secured with SSL. This means that the information is sent encrypted.

The practice website is secured with SSL, among other things. A processing agreement is available from the hosting provider.

I also have a data breach protocol.

Finally, my services are subject to legislation in the field of healthcare in the Netherlands and Dutch law in general, e.g. WGBO, Wkkgz and AVG.
